Understanding the Error: Ed Code 48900(k)(1) states that being disruptive and/or defiant shall not be grounds for suspension if the student is in grades IN, PS, TK, KN, 01 through 12. However, under Education Code section 48900 (k)(2) teachers may suspend students as authorized by EC section 48910 for disruption or defiance (Student Offense Code = 511). LEAs receiving this warning should check that the data are accurate. If the data are accurate, the LEA should check that the reported suspensions were made under EC section 48910; if not, the LEA should review its processes to ensure students are not inappropriately suspended for disruption or defiance.
