Prepare the Student and Parent for Transfer of Educational Rights at Age 18

A one-year advance notice and decision-support countdown for explaining which IDEA rights will transfer, what will not change, and how supported decision-making or another lawful arrangement may fit the student's circumstances.

In Plain Language: The IEP must tell the student and parent, no later than one year before age 18, that IDEA rights will transfer to the student at majority unless law provides otherwise. This is preparation—not a last-minute signature at the eighteenth birthday.

Why this matters

The student may soon receive notices, consent to evaluation or services, inspect records, and make dispute-resolution decisions. Families need time to understand options without assuming disability automatically removes adult rights.

Joint ownership

Owner: case manager/IEP team. Partners: student, parent, transition specialist, school psychologist, records staff, adult-service partners, and legal supports chosen by the family.

Operational workflow

  1. 1. At the IEP in effect when the student is 17, explain each right expected to transfer and document that both student and parent were informed.
  2. 2. Give accessible/native-language information and practice student participation in notices, consent, records, meetings, and self-advocacy.
  3. 3. Identify who will receive communications at 18 and any lawful decision-making documentation the family supplies.
  4. 4. On the eighteenth birthday, update contacts, rights holder, permissions, and records; send required notices to both student and parent where law requires.

One-year countdown

12+ months before 18: Explain the future transfer and options.
During the year: Build decision-making and self-advocacy skills.
At age 18: Verify the lawful rights holder and update every workflow.
