Provide Fiscal-Distress Reports to the County Superintendent

An implementation guide for recognizing studies, reports, evaluations, and audits that show fiscal distress and sending them to the county superintendent as Education Code 42127.6 requires.

Date(s)Event-triggered: when the district receives a study, report, evaluation, or audit showing fiscal distress, or a FCMAT or regional-team report

In Plain Language: If any study, report, evaluation, or audit shows signs of fiscal distress under the state's financial standards and criteria (EC 33127), or if FCMAT or another outside team issues a report, the district must send a copy to the county superintendent. The county then reviews it and may investigate and act.

Why this matters

Early disclosure gives the county a chance to help before a crisis. Withholding a distress report delays assistance, damages the county relationship, and can lead to stronger intervention later, including stays of actions such as bond issuances.

Joint ownership

District: superintendent and chief business official decide what qualifies and transmit it; the board is informed. County office: reviews, investigates, and may notify the board and State Superintendent.

From a new fiscal report to a documented county transmittal: the SDLA ITO workflow

This workflow makes sure a distress finding reaches the county instead of sitting in a file. This SDLA ITO (Input, Transformation, Output) graphic shows how the inputs become the outputs in 9 steps.

SDLA ITO: 9 steps. Input: receive the report; apply the standards and criteria; check prior correspondence. Transformation: screen for distress evidence; brief leadership and the board; transmit to the county. Output: transmittal record; response plan; updated interim assumptions.
Read down each column, then move to the next: Input identifies what to collect; Transformation covers screen for distress evidence; brief leadership and the board; transmit to the county; Output delivers transmittal record; response plan; updated interim assumptions. Event-triggered; send promptly after the report is received.
