Approve, Post and Review the ELO-P Program Plan
Maintain a board-approved ELO-P plan, publish the approved version and schedule the next review from the LEA’s actual approval history.
Operating conditions: access, hours, staffing and transport
Apply these state funding conditions throughout the 2026–27 program; they are not additional dated plan filings.
- Rate 1 must offer all classroom-based TK–6 pupils and provide access to those requesting enrollment; Rate 2 applies to unduplicated TK–6 pupils. Check the actual funding rate, prior-year UPP and statutory guarantee/transition rules before changing access. Exactly 55% is Rate 1; do not confuse the access rule with a site’s local enrollment count.
- Normally offer nine combined hours of instruction, recess/meals and ELO-P on schooldays, plus at least thirty nonschooldays with nine hours. The qualifying frontier designation permits eight hours and still thirty nonschooldays; verify the statutory geographic designation rather than assuming all rural sites qualify. Apply the specific ESY combination rule when relevant.
- Maximum pupil/staff ratios are 10:1 for TK/K and 20:1 otherwise. Direct supervisors must meet district instructional-aide minimum qualifications; site-supervisor selection requires principal approval. Apply health screening and fingerprint clearances for staff/volunteers, and the third-party incident-notice/report conditions.
- Fees must follow EC 8482.6: sliding scale based on income/ability to pay and waivers for free/reduced-price-meal-eligible pupils, homeless youth and known foster youth. Optional pupil participation does not waive an LEA’s required offer/access duties.
- Where a pupil’s school does not operate the program, the LEA must arrange the required transportation to the program site and return to the originating or LEA-established location. A voluntary documented parent transport-reimbursement arrangement does not relieve the LEA when a family declines or cannot transport. Retain offer, enrollment, schedule, transport and staffing evidence.
- If Attendance Recovery runs alongside ELO-P, preserve the full ELO-P offering and separately satisfy the certificated-teacher and accounting conditions of Attendance Recovery.

Exactly 55 percent UPP is Rate 1
Effective from fiscal year 2025–26, CDE defines ELO-P Rate 1 as prior-year UPP greater than or equal to 55 percent, and Rate 2 as less than or equal to 54.99 percent. Exactly 55.00 percent belongs to Rate 1; the county reference’s overlapping boundary must not be copied. Check the statutory Rate 1 multiyear guarantee and the actual CDE funding exhibits before reclassifying an LEA solely from one year’s UPP. Funding status and program-plan compliance are separate controls. CDE funding threshold and guarantee FAQ.

In Plain Language: Maintain a board-approved ELO-P plan, publish the approved version and schedule the next review from the LEA’s actual approval history.
Why this matters
Operational-intent reporting is a separate funding-participation task. It does not approve or publish the program plan.

Expanded-learning lead, governing-board office, fiscal services and participating partners
Required distinctions and controls
- CDE identifies governing-board review and approval every three years. Do not assign one statewide 2026–27 review deadline to all LEAs.
- CDE recommends public approval before the first program day and website posting within 30 days of approval. Treat the 30-day posting guidance as CDE’s recommended administrative timing rather than an independently verified statewide statutory due date.
- Use the current CDE plan guide, program conditions and local needs assessment. Consider earlier amendments when operations, partners, services or planned expenditures change; CDE describes revision for Attendance Recovery as a best practice.
Recommended LEA workflow
- Locate the latest approved plan and board minutes and establish the review history.
- Record the next three-year review date and identify operational changes requiring earlier revision.
- Review the current plan guide with program, site, fiscal and partner owners.
- Bring the reviewed plan through public board approval and publish the approved version.
- Test its public URL and retain the plan, minutes, revision log and next review date.
Evidence to retain
- Current approved plan
- Approval minutes and review history
- Needs and program review evidence
- Public URL
- Next review date and revision log
