Issue Timely Interdistrict-Transfer Decisions and Denial Appeal Notice

In Plain Language: A district must classify the request as current year or future year, record the receipt date, apply its published policy and evidence rules, and issue its final decision within the applicable statutory timeline. A final denial must advise the parent in writing of the right to appeal to the county board of education within 30 calendar days.

Why this matters

A delayed, verbal, or incomplete decision can erase meaningful appeal time and leave a pupil’s placement unresolved. The district of residence and proposed district may have separate decisions, policies, and local appeal steps; each must control its own timeline and record.

Decision owner: designated district administrator. Process owner: enrollment/student-services office. Partners: residence district, proposed district, program/capacity staff, translation/accessibility, and COE appeals office.

Operational workflow

  1. 1. Date-stamp the request, identify current or future year, and record the district role and applicable policy.
  2. 2. Review the stated reason, required supporting evidence, capacity/program conditions, and any local appeal step without introducing unpublished criteria.
  3. 3. Issue the final decision within 30 calendar days for current-year requests or by 14 calendar days after instruction begins for future-year requests.
  4. 4. Provide written notice through an authorized method and meet section 48985 translation requirements.
  5. 5. If denied, state the final denial date and the right to appeal to the county board within 30 calendar days; preserve the administrative record.
